Authorized Contact Person must be 18 years of age or older and does hereby represent and warrant that he/she is duly authorized by the participating organization to enter into this agreement on behalf of the organization. This is a binding contract.

This Agreement is made on this date between The Fundraiser Shop and Participant.  The Fundraiser Shop agrees to the following terms and conditions:
(a) Price of items includes delivery to one location, 1st floor. (b) Upon approval, terms of payment are Net-Due at end of program sale period.  30-day terms are available to pre-qualified customers only.  Payments must be submitted via check, credit card or money order and should be made payable to The Fundraiser Shop. Past due balances will be charged interest at the rate of eighteen percent (18%) per annum, or the highest rate permitted by applicable state law, whichever is lower.   All returned checks will be assessed a service fee of  $25 or the highest rate permitted by applicable state law, whichever is lower.   Customers also agree to pay any and all fees, including attorney fees, incurred by the company to collect bad checks and/or past due invoices. (c) If fundraiser is canceled by no fault of The Fundraiser Shop, customer agrees to pay all fees incurred by The Fundraiser Shop for current fundraiser.  This includes, but is not limited to, brochures, order forms, and shipping charges. (e) Products will ship based on availability and freight guidelines.  A specific delivery date or time cannot be guaranteed. (f) It is understood that if you choose student-packed vs. bulk on programs with an option of both, profit percent may be up to 7% less. (g) It is understood that perishable food items and customized items cannot be returned for credit unless an error on part of The Fundraiser Shop has been made.  A Return Authorization is required for all returns and can be acquired by contacting your Sales Representative. (h) All shortages must be noted on original delivery receipts and must be reported to our Customer Service department within 10 days of receipt.  Substitutions may occur due to product availability.  Customer must notify The Fundraiser Shop if the substitution is not acceptable within 10 days from product delivery.  Deduction from invoice will occur for all unsatisfactory substitutions.  The unsatisfactory product must be returned to The Fundraiser Shop. (i) Late orders will be accepted.  Profit percent for late orders is 20% less.  Late orders are subject to separate delivery and cannot be guaranteed at time of original order. (j) Participant agrees to accept full responsibility for all fund-raising items ordered and agrees to minimum order requirements as specified.  Participant also agrees to sell items and pay The Fundraiser Shop the amount due for each item sold.
 
Kansas and Missouri residents must have a Tax Exemption Certificate or Resale Exemption Certificate filed with Resource Solutions in order to exempt participant from sales tax on all fund-raising items purchased.  Candy fundraisers are subject to sales tax in CT, FL, MD, MS, OK and RI.  All other participants are responsible for any local sales tax.
